Present the Honorable

Aquila Paca, John Davidson, Samuel T. Wright, John H. Stone
Esquires.

A Petition from Benjamin Culver of Harford County was laid
before the Board, setting forth that he was employed as a Deputy
Sheriff for the said County, that in the Settlement of Accounts for
public dues with Mr. John Copeland he ignorantly took more than
was legally due, but withal saying that if he received any more than
was legal it should be rectified, that upon examining, he afterwards
discovered he had received One shilling or thirteen pence more than
he was legally entitled to, which he declares was done through in-
experience, that in Consequence of this Conduct he was called before
the Court of the said County to answer for the same, who considered
the Affair in so trivial a point of view that they fined him One shilling
and three pence only, being well satisfied it was through ignorance
and not design that the Clerk of the Court through a multiplicity of
Business omitted to make an entry of their Determination, which
occasioned him to be again called on to appear and was then recog-
nized in Fifteen pounds, That James Horner the then Sheriff being
at that Time confined in Gaol no recourse could be had to his papers
among which was the Execution so that when Culver attended Court
and not producing the Necessary Papers his Recognizance became
forfeited, And three of the Justices having certified the truth of the
facts contained in his said Petition, The Board are of Opinion that
the said Recognizance be remitted, and do hereby Order and direct
a Remission accordingly.
