tieth day of Octob^r One thousand six hundred Seventy Eight And
by the same tyme received of the Goods & M^rchandizes of the said
Edward & Comp^a that is to say att Severne River in the said Prov-
ince by the hands of James Connoway Comander of the Shipp Vir-
ginia ffactor of London five hundred & Eighteene pounds fourteene
shillings & foure pence currant money of England And also by the
hands of John Boddy Comander of the Cecilius of London att
Severne River aforesaid tenn pounds sterling money of England
Also by the hands of Joseph Scares late of Baltemore County
M^rchant Seaventeene pounds sixteene shillings & two pence lawfull
money of England Also by the hands of Daniel Bird Marryner
twenty three pounds of lawfull money of England As also by the
hands of the said Joseph Seares the quantity of twenty nine thousand
foure hundred forty fiue pounds of tobacco which in the whole
amounts to the sume of ffive hundred Sixty nine pounds tenn shil-
lings & five pence & twenty nine thousand foure hundred forty five
pounds of tobacco to render a reasonable accompt thereof to the
said Edward & Comp^a when he should be thereunto required Never-
thelesse the said Edward although often required hath not yet
rendred his reasonable accompt aforesaid to the said Edward & Comp^a

but hitherto hath denyed & yet Doth deny to render unto them the
same Whereupon they say they are damnified & have losse to the
Value of Seven hundred pounds sterling & thereupon they bring
their suite.
And the said Edward Gunnell by Kenelm Cheseldyn his Attorney
cometh & defendeth the force & injury when &c and saith that he
cannot deny the aforesaid action of the aforesaid plaintiffes, neither
but that he was Receiver of the Goods M^rchandizes & tobacco afore-
said of the same plaintiffes by the tyme aforesaid in the forme in
which the said plaintiffes have above declared against him And fur-
ther the said Defend^t saith that he is ready to accompt thereof There-
fore itt is considered by the Court here this day to witt the fifth day
of June in the fourth yeare of the Dominion of Charles Lord Balte-
more &c Annoq Doni 1679 that the aforesaid Defend^t accompt with
the said plaintiffes of the Goods M^rchandizes & tobacco aforesaid
of the same plaintiffes by tyme aforesaid received in the forme in
which the plaintiffes have above declared against him And hereupon
John Waterton & John Stansby of Baltemore County gentt in the
p^rsence of the same Defend^t are assigned Auditors by the Court
here to heare the said accompt. Which said Auditors have given
day to the parties aforesaid before them att Baltemore County afore-
said on the first day of July next comeing & so from day to day
untill the said accompt shall be fully stated audited & determined
So as they make their report thereof to the Justices of the same
Court to be held att the City of S^t Maryes the seventh day of Octob^r
next being the first day of the next Provincial Court
