John Wynn agt Jane WmsAdmx Wm Williams

Jane Williams late of St Maryes County Execrs of the last Will & testamt of William Williams de- ceased was Attached to Answer unto John Wynn in a plea of trespas upon the case

And whereupon the said John by Kenelm Chesel-
dyn his Attorney complaineth, that whereas the said W^m Williams
in his life tyme to witt the fifth day of July in the yeare of our Lord
One thousand six hundred Seventy eight did languish of divers &
severall distempers of body, to witt of a certaine distemper called a
feavour or a seasoning As also of a fracture in the skull by a fall
from of a horse And the said John haveing for severall yeares past
in this Province as also att this p^rsent tyme used to practise Phisick
& Chirurgery with good successe, the said William Williams in con-
sideracon that the said John Wynn would then Administer unto him
the said W^m Williams such Medicines & meanes as he the said John
Wynn in the best of his skill & judgm^t thought most proper for the
recovering of him the said W^m out of the said distempers he then
languished of as aforesaid, the said William Williams did assume
upon himselfe & to the said John did faithfully promise, that he the
said William would satisfie & pay unto the said John for all such
medicines & meanes as he should Administer unto him the said
W^m dureing the tyme he should so languish of the distempers afore-
said And also for his tyme & trouble spent in visitts of him the said
W^m dureing the tyme aforesaid what for the same he should deserve
As also for some other Medicines & meanes which the said W^m
before that tyme had & received of him the said John would satisfie &
pay to the said John also for the same what he should deserve And
the said John in fact saith that he the said John dureing the tyme of
the said W^m Williams languishing of the distempers aforesaid, he
the said John did Administer unto him the said W^m such Medicines
& meanes as in the best of his judgem^t he though most fitt & proper
for the recovering the said W^m out of the distempers aforesaid And
also gave attendance on him as farr as was necessary & convenient,
for which & for the Phisick which before that tyme the said W^m
Williams had & receiued of him he did well deserve the Sume of two
thousand nine hundred & Seventy pds of tobacco, a particuler of all
which Medicines meanes & attendance dureing the tyme of the said
W^m languishing as aforesaid, as also the other medicines & meanes
which before that tyme he had & received of the said John Wynn is
here in Court produced Notwithstanding which the said W^m Wil-
liams in the life tyme of him the said W^m the said sume of two thou-
sand nine hundred and Seventy pounds of tobacco according to his
promise hath not paid nor she said Jane Williams since his death
Ex^x of the last Will & testm* of him the said W^m but the same to
pay hitherto hath & still denyes to pay to the damage of him the said
John the Sume of foure thousand pounds of tobacco & thereupon he
brings his suite.
