And the aforesaid John Richardson by Robert Ridgely his At-
torney cometh & defendeth the force & injury when &c and prayeth
liberty to imparle hereunto untill next Provintiall Court & itt it
granted unto him, the same day is given to the plaintiffe also.
Now here att this day to witt the seventh day of June in the fourth
yeare of the Dominion of Charles Lord Baltemore &c Annoq Doni
1679 cometh as well the said plt as the said Defendt by their At-
torneys aforesaid And the said Defendt by his said Attorney saith,
that he of the debt aforesaid by vertue of the writeing aforesaid

ought not to Be charged, because he saith that itt is not the deed of
him the said John Richardson, & of this he putts himselfe upon the
Countrey And the plt also Therefore itt is comanded the Sheriffe of
St Maryes County that he cause to come here twelve &c by whom &c
and who neither &c to recognize &c because as well &c On which said
seventh day of June in the yeare aforesaid came the said parties by
their Attorneys aforesaid And the jurors impannelled being called
likewise came to witt John Evans, Stephen Murty, Samuell Asbiston,
Richard Sweatnam, Anthony Evans, Nicholas Hacket, Robert Smith,
Henry Penington, James Harrison, John Watson, Robert Toate &
Elias Beech who being Elected tryed & sworne to say the truth in the
prmisses upon their Oaths doe say that the writeing aforesaid is the
Act & Deed of him the said John Richardson Therefore itt is con-
sidered that the said Abigail Wright Admx as aforesaid recover
against the said John Richardson the Sume of foure thousand nine
hundred thirty eight pounds of tobacco the debt aforesaid And also
One thousand & sixteen pounds of tobacco costs of suite And the
said Defendt for that he hath denyed his own deed may be taken &c

Mary Pope late of Charles County widdow was Sum-
oned to answer unto Philip Lynes of a plea that she
render unto him certaine Chatties to the Value of
Eleven thousand Eight hundred & sixty pounds of
from him she unjustly detaines.

And whereupon the said Philip by Christopher Rousby his At-
torney saith, that he the twenty fifth day of April One thousand six
hundred Seventy seven delivered to the aforesaid Mary Chatties that
is to say, one three yeares old heifer & her Calfe, three Cowes &
Calves, one bay Mare, one bay stone horse, one sorrell filly, one
Cupboard, one iron pestle, one iron pott & one paire of pott bookes
to the Value of Eleven thousand Eight hundred & sixty pounds of
tobacco to be safe kept, & to him the said Philip Lynes when she
should be thereunto required to be redelivered Yet the said Mary
though often thereunto required the Chatties aforesaid to him the
said Philip she hath not as yet redelivered, but the same hitherto to
redeliver hath denyed & as yet doth deny & unjustly detaine, where-
upon he saith he is damnified & hath losse to the Value of ffourteen
thousand pounds of tobacco & thereupon he bringeth his suite
