Memorandum that att a Provinciall Court held
the day of October in the second yeare of the
Dominion &ca & in the yeare of our Lord one
thousand six hundred Seventy seven here prsent
in Court Kenelm Cheseldyn Attorney Genll of
the said Lord Propry In his proper person who

for the said Lord Propry followeth in this behalfe, & exhibitteth to
the Court here his certaine Informacon against James Stavely of
Cecil County & Henry Stocket Execrs of the last Will & Testament
of Nathaniel Styles deceased, thereby giveing the Court here to
understand & be informed

That whereas the said Nathaniel in his life tyme to witt the six-
teenth day of April in the yeare of our Lord One thousand six hun-
dred Seventy two by a certaine writeing under the hand of the said
Nathaniel did binde himselfe his heyres Exrs & Admrs to pay unto
the Honble Charles Calvert Esqr now Lord & Propry of this Province
the sume of three thousand Seven hundred Eighty two pounds of
tobacco upon demand In consideracon whereof the said Nathaniel
did assume upon himselfe that he the said Nathaniel the said sume
of three thousand Seven hundred Eighty two pounds of tobacco
would according to the tenour of the said writeing well & truely
content & pay Notwithstanding which the said Nathaniel the same
hath not paid in his life tyme according to his promise, nor the said
James & Henry since his death Execrs of the last Will & testament
of the said Nathaniel hath not paid though often thereunto required,
but the same to pay hitherto hath & still doth deny to pay to the
damage of the said Lord Propry the sume of six thousand pounds
of tobacco Whereupon the said Kenelm Cheseldyn as aforesaid for
the said Lord Propry prayeth advice of the Court in the prmisses
And that the said James & Henry may come here in Court & Answer
the said Lord Propry upon

And the said James & Henry by Robert Ridgely their Attorney
come & defend the force & injury when &c and pray liberty to im-
parle hereunto untill next Provinciall Court & itt is granted unto
them, the same day is given to the said Kenelm Cheseldyn Attorney
Genll &c likewise

Now here att this day to witt the ffifteenth day of Octobr in the
third yeare of the Dominion of Charles Lord Baltemore &c Annoq
Doni One thousand six hundred Seventy Eight came aswell the said
Kenelm Cheseldyn Attorney Genll aforesaid as the said Defendts by
their Attorney aforesaid And the said Henry & James by their said
Attorney say, that the aforesaid Kenelm Cheseldyn Esqr Attorney
