Genll of the said Lord Propry ought not to haue his action aforesaid
against them, because they say that the aforesaid Nathaniel in his
life tyme the said sume of three thousand seven hundred Eighty &
two pounds of tobacco to the said Charles Calvert Esqr now Lord

Propry ofThis Province did pay & satisfie And this they are ready
to Verifie whereupon they pray judgemt whether the aforesaid
Kenelm Attorney Generall as aforesaid ought to haue his action
aforesaid against them And the said Kenelm Attorney Genll afore-
said saith that the said Nathaniel did not pay the said sume of three
thousand seven hundred Eighty two pounds of tobacco as aforesaid
& prayes itt may be enquired by the Countrey And the said Admrs
likewise Therefore itt is comanded the Sheriffe of St Maryes County
that he cause to come here twelve &c by whom &c and who neither
&c to Recognize &c because as well &c Att which said ffifteenth day
of October in the yeare aforesaid came aswell the said Kenelm
Cheseldyn Attorney Genll aforesaid as the said Defendts by their
Attorney aforesaid And the Jurors impannelled being called like-
wise came to witt Tho: Hedge, Wm Thomas, Randall Revell, Henry
Parker, Joseph Tilly, David Holt, John Highland, Morgan Jones,
John Warren, Jno Hollins, Tho: Pattison & Thomas Jones who
being Elected tryed & Sworne to say the truth in the prmisses upon
their Oaths doe say that the said Nathaniel Stiles did not in his life
satisfie & pay unto the said Lord Propry the said Sume of three
thousand Seven hundred Eighty two pounds of tobacco And they
assesse the damage of the said Lord Propry to three thousand Seven
hundred Eighty two pounds of tob: Therefore itt is considered by
the Court here that the said Kenelm Attorney Genll as aforesaid
recover against the said James Stavely & Henry Stocket Exrs as
aforesaid as well the sume of three thousand Seven hundred Eighty
two pounds of tobacco damages by the jurors aforesaid in forme
aforesaid assessed As also Nine hundred Sixty & six pounds of
tobacco costs of suite And the Defendts in mercy &ca

Edward Williams otherwise called Edward Wil-
liams of the County of Talbot was Sumoned to
answer unto Wm Calvert Esqr of a plea that he
render unto him the full quantity of Eight thou-

sand pounds of good sound Mrchantable tobacco in cask which to
him he owes & unjustly detaines
And whereupon the said Wm Calvert by Kenelm Cheseldyn his
Attorney saith, that whereas the said Edward Williams the Eight-
eenth day of April in the two & fortieth yeare of the Dominion of
Cecilius One thousand six hundred seventy foure by his certaine
bond or writeing Obligatory Sealed with the Seale of him the said
Edward & here in Court produced whose date is the day & yeare
aforesaid, did confesse & own himselfe to be holden & firmly bounden
unto the said Wm Calvert in the full quantity of Eight thousand
