shall be understood therefrom to have any Right to break the said
Ground to bury the Corps of any one Deceased and if any Person
or Persons shall hereafter Presume or Attempt to Bury any Corps
or dead Body within any Part of the said Ground so as aforesaid
Appropriated to Build the said Chapel on he she or they so Offending
shall forfeit and pay the sum of Ten Pounds Current Money the one
half thereof to be paid to the Vestry of the said Parish to be by
them Applied towards the Repairs of the said Chapel the other half
to whoever shall Sue for the same together with full Costs of Suit
to be recovered by Action of Debt in the County Court

And be it further Enacted That Messures James Anderson Wil-
liam Ringgold, William Bordley, Emory Sudler and James M.cClean
now dwelling and residing in the said Chester Town shall be and
are hereby Appointed Trustees and they or any three of them are
hereby impowered to Contract with Proper Workmen, Purchase
Materials, and carry on and finish the Building and Compleating a
good Brick Chapel sixty feet long forty feet wide and two Story's
high with a Stone foundation on the Ground aforesaid and the
Sheriff of the County aforesaid is hereby directed and required to
pay the fifty thousand Pounds of Tobacco by the above recited Act
Appropriated to make an addition to the House of Worship in the
said Town to the Order or Orders of the said Trustees or any two
of them any Thing in the said recited Act to the Contrary Notwith-
standing And the said Trustees or any three of them are hereby
impowered to receive the said fifty thousand Pounds of Tobacco of
the said Sheriff or draw an Order or Orders for the same and also
to receive the Monies so said to be Subscribed or that shall hereafter
be Subscribed towards building the said Chapel or to Sue for and
recover such Monies in Case the Subscribers should neglect or refuse
to pay the sum subscribed by them respectively and also to Number
and dispose of the Pews or Seats that shall be made in the Second
Story of the said Chapel exclusive of a sufficient common Gallery
and also exclusive of such as may be wanted in the second Story to
Accomodate the Proprietors of the Old Church and the Owners of
Lotts and Subscribers to the said new Chapel as herein after directed
at Publick sale to the highest bidder who shall be a Freeholder of
fifty Acres of Land at least within the said Parish on which some
Person or Persons are dwelling and pay Taxes within the Parish and
which Freeholders shall not have a Pew or Seat in the Lower part of
the said Chapel and receive the Money arising by the Sale of the
said Pews all which fifty thousand Pounds of Tobacco, Subscription
Money, Money Arising from the Sale of the said Pews and the
Bricks and other Materials of the old Church they shall Apply towards
the Building and finishing the said Intended new Chapel
