Charles County Court Proceedings, 1674. 607 Whereas a writt of Capias was issued forth against Michaell Judd Liber F at the suite of John Mould & returned by the sherife non est inventus, An Attachment is granted by order of Court to the sd John Mould plaintife against the goods Chattles & Creddits of the sd Michaell Judd Defendant for tht the Defendt is not to be found within the County. In a Cause depending betweene John Muńs plaintife & Cuthbert Musgrove Defendant, the plaintife preferres this ensueinge petition. To the Worshipfull Comissioners of Charles County John Muńs humbly sheweth. That whereas Cuthbert Musgrove of Charles County standeth indebted unto John Mufls of the same County in the full & just quantity of two thousand five hundred pounds of good sound mer- chantable leafe tobaccoe & Caske to be paid upon Demand unto the sd John Munes his heires Execrs Admrs or Assignes as by a certaine writeing obligatory sealed with the seale of him the sd Cuthbert whose date is the 27th day of January 1673 here in Court produced now plainly may appeare. Yett neverthelesse the sd Cuthbert his obligacon little mindeing [p.31] or reguarding, but deviseinge & fraudulently intending him the sd John of the sd sume of 2500 lb tobacco to deceive the sd sume of 2500 lb although often thereunto required, hath not satisfied but doth altogether refuse to pay the same, Whereupon the sd John saith hee is damnified & hath lost to the value of 2900 lb of tobaccoe & thereupon hee bringeth his suite, & humbly Craves the judgemt of this worshipfull Court & yr petitioner shall ever pray &c Whereupon the plaintife John Munes produceth the sd writeinge obligatory in open Court, & the Defendant Cuthbert Musgrove Con- fest judgement for the sume of nine hundred & twelve pounds of tobaccoe which was remaineinge due of the sd bill to be paid by the Deft Cuthbert Musgrove to the pltf John Munes with Cost of suite Bill of costs Entred To his comeing goeinge & Attendance 4 dayes 120 lb at 30 p diem 360 lb tob To John Helme & Roger Dickison for evidencel Charge 4 dayes each at 30 lb p diem 240 In a Cause depending betweene John Allen as Admr of all & singular the goods & Chattles of John Hitchinson dee, plaintife & Gerrard Browne who married the Relict of William Allen dec Defendant. Gerrard Browne who married the Relict of William Allen dec was attached to Answer unto John Allen Admr of all & singular the goods & Chattles &c of John Hitchinson dec in an action of the Case Whereupon the sd John Allen (by John Jones his Atturney) saith that whereas John Hitchinson in his life time was sundry wayes |
