6o6 Charles County Court Proceedings, 1674. Liber F is the same day & yeare, Did acknowledge himselfe to owe & stand firmely indebted unto the sd Matthias the full & just sume of One thousand foure hundred seaventy & Eight pounds of good sound [p.30] Merchantable leafe tobaccoe & Caske, To be paid to the sd Matthias his heires Execrs & Admrs at or before the tenth day of Octob then next ensueinge, Notwithstanding the sd David though often de- manded the sd sume of 1478th of tob & Caske according to the tenour of the sd Obligacon hath not paid or rendred, but the same hitherto hath neglected & refused & still doth refuse to pay, Whereupon the sd Matthias saith hee is damnified, & hath loste to the value of two thousand two hundred pounds of tobacco & thereupon hee brings his suite Whereupon this ensueinge bill was produced in open Court Know all men by these presents that I David Thomas of Charles County in the Province of Maryland planter doe acknowledge & Confesse to stand firmely indebted unto Matthias OBryan of the same County & Province aforesd to him his heires Execrs Admrs or Assignes the full & just sume of one thousand foure hundred seaventy & eight pounds of good sound Merchantable leafe tobaccoe & Caske to conteine the same, to be paid at or before the tenth day of Octob next ensueinge the date hereof, & allsoe the sd is to bring the tobaccoe downe to the now dwellinge house of Matthias OBryan, & for the true performance of the abovesaid premises to be well & truely made & done, I the sd David Thomas doe binde my self e my heires Execrs & Admrs firmely by these presents in wittnesse whereof I have hereunto sett my hand & seale this 2d day of March: Anno 1671 his marke Signed sealed & delivered David D T Thomas in the presence of (locus) sigilli Francis Adams Hugh Mackenemar Whereupon the Defendant David Thomas con fest judgement in open Court to the Plaintife Matthias OBryan for the sume of 1478 lb of tobacco with Cost of suite Bill of Costs To Atturneyes Fees 200 lb tob To Francis Adames 3 dayes at 30 090 Sume 290 Whereas a writt of Capias was issued forth against Edward Hathond (& returned by the sherife non est inventus) at the suite of Humphrey Warren An Attachment is granted by order of Court to the sd Humphrey Warren plaintife against the goods Chattles & Creditts of the sd Edward Hathond Deft for the sume of three thou- sand pounds of tobaccoe for tht the Deft is not to be found in the County |
