Charles County Court Proceedings, 1671—1674. 561 In a cause depending between Francis Wine Plaintiff and Francis Liber E Kylborne Deft the Plaintiff by his Attorny Sam Cressy declares agt the Deft for that whereas Some tyme about the month of August Anno Dñi 1673 at the Instance and request of the §d Francis Kyl- borne the sd Francis Wine did Sett up for him the sd Francis Kyl- borne foure tonne of tob hds: In consideracon whereof the sd Fra: Kilborne did assume on him Selfe & to the §d Francis Wine did faythfully promise the Sume of foure hundred pounds of tob: yet Nevertheless the sd Francis Kilborne hath not pd the Same allthough often required to the great damage of him the sd Wine, & therefore he brings his Suite: And the sd Francis Kilborne by his Attorny Jno Jones comes and defends the Suite, & Sayes tht the sd Wine ought not to have his accon agt the sd Kilborne for that he did not assume in mannr & forme as is wthin exprest in the declaracon and putts himself upon the Countrey: And the sd Fra: Wine likewise whereupon it was ordred that a jury Should be impanettd whose names are here written Tho Corker foreman Geo: Godfrey Joseph Bu!loit Jobe Corner John Lambert John Godshall Micti Minock Henry Barnes Jno Bos- [p. 178] well Cleborne Lomax Giles Cole Richd Beck wch Jury brought in this ensueing virdict, That they find for the Plaintiff wth cost as followes; To Attornys fees 60 To Francis Wines attendance 2 dayes at 30 lb p diem 60 To Lueis Foster two dayes 60 To Thomas Bull 2 dayes 60 To the Jury 120 360 wch costs was allowed by the Court In a cause depending between Jno Peirce Plaintiff and Thomas Gibson Admr to Thomas Cotton Deft referrd untill the next Court; Whereas there was an attachtht formerly granted to Jacob Peterson agt the Estate of Mich Ashford & layd in the hands of Tobias Crayford: it is now ordred that Tobias Crayford give Securety for his appeareance the next Court to prove the paytht of that tob wch was due to Michaell Ashford for Deborah his wife, otherwise to pay to Jacob Peterson one thousand poundes of tob wth costs The attachtht that was formerly granted to Henry Adams agt the Estate of Michaell Ashford for the Sume of nine thousand pounds of tob is now ailso continued: untill the next Court In a cause depending between Jno Lemaire Plaintiff and Jno Kymbrow Deft a reference granted untill the next Court 39 |
