In a certaine difference dependinge betweene John Kimborow Plt
& Richard Ambrose Defdt the Plt declares by his Attorn Samuell
Cressey And the Defdt appeares to defend the Suite Vizt the Plt
saith that on the 28th of January 1672 at the request of the Defdt
he lent the Defdt 800 lb tob in Cask which the Defdt assumed &
pmised to pay unto the Plt either in tobacco or goods as cheape as
any man sold elsewhere, which the Pltf demandinge, the defdt
neglectinge & refuseinge to pay the same to the pits damage 1000 lb
tob who proveinge his declaracon by the subsequent witnesses
Richard Dod Thomas Pope & John Bayley, the Court ordered a
venire facias to be entred & directed to the Sherriff who impannelled [p. 134]
twelve men whose virdict was that the Defdt pay unto the Plt 800 lb
tob with Costs which followes vizt.
