500 Charles County Court Proceedings, 1671—1674. Liber E formerly disposed of to the sd Baker and Excepted in the assigne- ment of the sd land to John Nevell To have & to hold the sd pcell of land to the sd Thomas Baker his heires executrs & admrs to their owne propper use & behoofe for ever, he or they payinge yearely acknowledgemt for the same to me my heires executrs or admrs or ass One Eare of Sound Indian Corne when lawfully demanded War- rantinge unto the sd Baker his heires executT5 & admrs the sd pcell of land from any pson or psons wtsoev Moreover I doe by theise pntes I doe freely cleare & quitt any claime or title that I or any for under me may might or could have to the land whereon the said Baker doth live, And is in his possion to him the sd Thomas Baker for ever hereby acknowledgeinge to have reed satisfaccon of him for the same In witnes whereof I have hereunto sett my hand & Seale this 3d day of September 1673. John Jarbo (loc Signed Sealed & delivd Sigit) in the pnce of us Sa: Cressey: Nicholas Noyall [p. 134] Whereas At a Court held in Charles Countie on the 15th of Novembr 1665 Walter Story obteyned Judgemt agst Wm Price & John Lambert Admrs of John Nevill deceased for the sume of thirteene hundred eighty six pounds of tobacco as by the sd Judgemt relacon beinge thereunto had more plainly may appeare Theis are therefore to certifle whom it may concerne That I Henry Bonner of Charles Countie Gent haveinge marryed Elizabeth Story the Relict & Admrx of Walter Story dec doe acknowledge to have reed of Thomas Hussey who marryed the Relict of John Nevill dec full Satisfaccon for the sd sume menconed in the Judgemt of Court aforesaide In witnes whereof I have hereunto sett my hand this 11th day of June 1673 Henry Bonner The above menconed rect was acknowledged in open Court by the sd Henry Bonner unto the sd Thomas Hussey. In a certaine difference dependinge betweene Phillip Lynes Plt & Samue!l Cooke Defdt the Plt declares by his Attorn Richard Boughton & the Defdt appeares by his Attorn Nicholas Best to defend the Suite vizt The Plt saith that on the 28th of May last he con- tracted with the Defdt for a pipe & a hhd of Fayal wine at a certaine price betweene them (vizt) 2500th tob for the pipe & 1250 lb tob for the Mid & that the Defdt did assigne & pfix a day for the delivy of the sd wynes (vizt) on the 29th of the same May, And the Plt come- inge at his preflxt day to demand the wyne the Defdt did not deliv but refused to deliv the sd wyne to the Plaintiffs damage 3000 lb tobacco as he saith The Plt provinge by the Testimonies of Wm Boyden Jacob Peter- son Hen: Appleby Tho Cooper Nich: Grosse John Kimborow & Tho: Warner the above declaracon the Court ordrd a venire facias |
