394 Charles County Court Proceedings, 1671—1674.

         Liber E    unto had more playnely may appeare in all amounting to the Sume
               of eleven hundred & Seventy two pounds of tobacco now Soe it
               is tht the sd Jno the quantity of 1172 poundes of tobacco to the
               said Nicholas has not Satisfyed alithough often thereunto required,
               but doth refuse to pay the same whereupon the sd Nicli Sayeth tht
               he hath loss & is damnefyed to the value of 1500 poundes of tob and
               thereupon he brings his Suite

         [fol. 69] Keiham Maglouglin Sworne in the behalfe of the Dft and de-
               clares tht in Spring last he heard Nich Salsby demand 12 hundred
               pounds of tob of John Wheeler and the Said Wheeler answeared
               him tht it was to much and at the same tyme proferd him eight
               hundred poundes of tob and allso requested Salby to Shew him his
               accot and he refused it;
                The oath of Ralph Coates who was Sworn in the behalfe of the
               Deft who declares tht Some tyme in Aprill last past Nich Salby came
               to the house of the said Wheeler and haveing Some wordes of con-
               troversy the Said Nich demanded 12 hundred pds of tob and the
               said Wheeler demanded his accopt and the Said Salby refused, and
               the said Wheeler answered he would not pay it wthout a pticular
               acct & farther sayes not,
                hereupon the plt craves tht a Jury may be impanneld upon it,
               Which the Court has granted; The Worshpfull Comishoners have
               ordred tht a Venire facias be entred; wch is done, the Juryes Verdict
