128 Charles County Court Proceedings, 1666—1668. Liber C To the Worple the Commissionrs of Charles Countie And whereupon the said. Nicholas Complained against the said John For tht tht is to say That whereas the said Nicholas diverse and Sundrie times at the instance and request of the said John Sold and delivered to the said John in ordinanie Accommodacons soe much as in the whole amounteth to the summe of fourteen hun- dred, and thintie pounds of tobaccoe an accompt whereof the said Nicholas hath readie to be produced in Court wch said totall sume of fourteen hundred and thintie pounds of tobaccoe and all and Severall the Summes in the said Account from time to time acnueing and amounting theneunto the said John did. Assume upon himselfe and faithfullie promise That he the same to the said Nicholas well and truelie would satisfie and pay when he should be thereunto required But Notwthstanding the said John to the said Nicholas the said Severall Summes amounting to the said 1430 lb of tobaccoe though often thereunto required. hath not Satisfied on in anie manner for the same Contented, and paid But doth alltogether refuse to Satisfie the same Whereupon the said Nicholas brings his suite Hereupon the Defendt Acknowledged a Judgment for the said Summe of fourteen hundred and thirtie pounds of tobaccoe to the Plaintife Ordered therefore That the Defendt Satisfie and pay unto the Plaintife the said Summe wth Costs and Change of suite. Robert Sampson Plaintife William Thomas Defendt In a plea of trespasse upon the case Alexander White came into Court and Produced this ensueing Letter of Attorney to him from William Thomas Know all men by these presents That I William Thomas doe Constitute, Authorize and Appoint Alexander White my true and Law full Attorney for me and in my Place and stead to request and Crave a refference untill the next Court or Courts held in Charles Countie after this Court then and there to Answr to Robert Samp- son what shall be alleadged Witnes my hand this 4th Day of Apnill Anno Dni 1668. William Thomas Signed, Sealed & Delivered X in the presence of us Jonathan Marler Thomas [blank] [p. 265] Ordered therefore That there be an Imparlance of this suite till the next Court to be held on the 2d tuesday in June next ensueing John Muns Plaintife Bennet Marchagay Defendt In a plea of Debt The Plaintife made his personall appearance to Prosecute the said Suite agt the Defendt The Defendt did Likewise personallie appeane to defend the same |
