Ordered Therefore That the said Beane Satisfie and Pay the said Liber C
9 Barrells and a halfe of Come to the sd James Bowling
Nicholas Emanson Summoned Mr James Lyndsey to Answr to
him in a plea of trespasse upon the Case for 561 lb of tobaccoe wch he
saith the Mr Lyndsey oweth him and detaineth upon wch he
declareth as followeth
To the Worple the Commissionrs of Charles Countie.
And whereupon the said Nicholas Complaineth against the said
James For that that is to say That Whereas the said Nicholas at
diverse and Sundrie times and at the instance and request of the
said James Sold and delivered to him the said James in Ordinarie
accommodacon the soe much as in the whole Amounteth to the
Summe of five hundred sixtie one pounds of tobaccoe an Account
whereof the said Nicholas is readie to Produce in Court said
Totall Summe of 561 lb of tobaccoe & all and Severall the particular
Summes in the said Account from time to time acrueing and Amount-
ing thereunto the said James did assume upon himselfe and faithfullie
promise That he the same to the said Nicholas well and truelie would
Satisfie and Pay when thereunto Required But yet Notwithstanding
he the said James not regarding his said promise and Assumption
hath refused to Satisfie the said 561 lb of tobaccoe to the said
Nicholas and doth still refuse to doe the same Whereupon he brings
his suite
Hereupon the said Nicholas and the said James Produced their
Severall Accounts in Court and It was ordered tht Stephen Montague
and George Thompson should Audit the same and make report
thereof to the Court wch accordinglie they did and found That W
James Lyndsey did stand indebted unto Nicholas Emanson in the
quantitie of 351 lb of tobaccoe upon the Ballance of all Accounts
between them from the Beginning of the world till this present time
Ordered Therefore tht the said W Lyndsey Satisfie and Pay unto
the said Nicholas the said Suñie of 351 lb of tobac wth Charges and
costs of suite.
Absolam Coveant Plaintife John Dowglas as Adminr of the
estate of Bridget Heard decd Deft
In a Plea of Debt.
The said Absolam Coveant the Plaintife made his personall Ap-
pearance to Prosecute the said Suite Commenced by him against the [p. 258]
said John Dowglas the Defendt. The said John Dowglas appeared
to Defend the same.
Hereupon the Plaintife declared against the Defendt as follow-
eth vizt.
To the Worple his Lordships Justices in Charles County.
And Whereupon the said Absalom Complaineth against the said
John For tht tht is to say That whereas Bridget Heard aforesaid
