as Adminr of the estate of estate of Arthur Turner decd De
Richard Smyth decd fendt
In a Plea of trespasse upon the case
The said Francis Pope the Plaintife made his personall Appearance
to prosecute the suite Commenced by him as aforesaid agt the said
Walter Beane the Defendt who Likewise made his personall appear-
ance to defend the same.
Hereupon the Plaintife Declared upon an Account for severall
things had of Arthur Turner in his life time from Richard Smyth
was as followeth
Mr Arthur Turner Debtor to the Estate
of Richard Smyth late decd as followeth.
For his Sonnes diet one yeare 550 lb tob.
It. for one Steare 600
It. for two hides 100
It. for one quarter of Beefe 090
It. for Sixteen gallons of Syder 160
Likewise the Plaintife further Declared upon a Bill passed by the
said Turner to the said Pope in his life time for the Payment of
1074 lb of tobaccoe wth was as followeth (vizt)
This Bill bindeth me Arthur Turner my heires Executors and
Administrators to pay or cause unto Francis Pope and John Hatch
two of the Adminrs of the estate of Richard Smyth their heires
Executors Adminrs or assignes the full and just Summe of one
Thousand Seaventie foure pounds of tobaccoe and Caske to be paid
at some Convenient place in Charles County at or upon the tenth
day of November next ensueing the Date hereof As Witnes my hand
this 2d Day of Aprill 1664. Arthur Turner

Whereupon the Defendt demanded an Allowance of the Summe of
550th of tobaccoe for Caske, and 300 lb of tobaccoe for a Suite of
Cloathes due from the estate of Richard Smith to the estate of
Arthur Turner and requested tht both the said Summes might be
deducted out of the Totall Sume of 2574 lb of tobaccoe for wch the
Plaintife sued which was done accordinglie and the Remainder being
1724 lb of tobaccoe the Defendt acknowledged a Judgement for the
same to the Plaintife and the Court thereupon ordered tht The
[p. 257] Defendt should Pay and Satisfie the said Summe of 1724 lb of to-
baccoe to the Plaintife, but the Plaintife to pay costs of suite.
Likewise the said mr Beane acknowledged a Judgment for 9
Barrels and a halfe of Corne at 60 lb of tobaccoe p Barrell due to
James Bowling from the estate of Arthur Turner aforesd decd
