[Preamble]

An Act to revive and aid the proceedings of Cecil County Court

Whereas Cecil County Court held in the Month of March in the
year one thousand seven hundred and Sixty four was by adjourn-
ment continued untill the fifteenth Day of May in the same year, at
which fifteenth Day of May a new Commission of the Peace for
the said County was opened and published, under which none of the
Commissioners therein named did qualify themselves by Reason
whereof the Actions, Process and Proceedings depending and un-
determined in the said March Court were discontinued; for aiding
therefore the said Actions Process and Proceedings and so far as
may be relieving the Suitors of the said Court from the Loss and

damage that might be occasioned by such discontinuance.

Be it enacted by the Right Honourable the Lord Proprietary by
and with the advice and Consent of his Lordships Governor and the
Upper and Lower Houses of Assembly and the Authority of the
same That all Actions Process and Proceedings as well Criminal as
Civil which were depending and undetermined in the said Cecil
County Court held in the Month of March in the year one Thousand
Seven hundred and Sixty four except as herein after excepted, shall
be construed judged and taken to be in the same Situation state
and Condition at the next March Court to be held for the said
County, and the Justices of the said County Court for the time being
may then proceed to the hearing and determining or further continu-
ing and thereafter hearing and determining the said Actions Process
and Proceedings respectively as the Case may require as fully and
effectually as the Justices of the said Court held in the said Month of
March in the year one Thousand seven hundred and Sixty four
could or might Lawfully have done the said Discontinuance or any
other Matter or Thing to the Contrary in any wise notwithstanding

Provided nevertheless That in case any Plaintiff or Plaintiffs in
any Suit or Suits so discontinued hath or have brought his her or
their Action or Actions a new Since Such Discontinuance and hath
or have caused or procured the Defendant or Defendants therein to
be arrested or where either the Plaintiff or defendant in any of the
said Actions hath died Since such Discontinuance by reason whereof
