or Proprietor thereof Provided also that where the Tobacco levied
as aforesaid shall not be applied to the Uses aforesaid then the
Justices of the County Courts where such application shall not be
made shall apply the Tobacco so levied to the County the ensuing year.

No. 7 An Act for the Building a Vestry House at Saint Paul's Church
in Kent County.

Whereas the Vestrymen Church Wardens and other Inhabitants
of Saint Paul's Parish in Kent County have by their petition to this
general Assembly represented that there is at this Time a Large Quan-
tity of Tobacco in the hands of the said Vestry over and above the
necessary Repairs of the said Parish by Reason of a vacancy of an
Incumbent in the said Parish for some time past and pray that the
said Vestry may be enabled to apply Twenty Thousand Pounds of
the said Tobacco towards erecting and finishing a Sufficient and
convenient Vestry House at the Parish Church of the said Parish
and for the same when built to be and remain under the Care of the
Vestry in the same manner as other parish Buildings

Be it therefore enacted by the Right honourable the Lord Pro-
prietary by and with the advice and consent of his Lordships Gov-
ernor and the Upper and Lower Houses of Assembly and the
authority of the same That it shall and may be Lawful for the Vestry
aforesaid and they are hereby directed and required in some short
Time after this session of Assembly to contract and agree with some
proper Person or Persons for the erecting, building, finishing, and
compleating a sufficient and convenient Vestry House at the place
aforesaid in the best manner they can so as not to cost above
twenty thousand Pounds of Tobacco at the most the Cost of which

said Vestry House not exceeding twenty Thousand pounds of To-
bacco as aforesaid they are hereby impowered to pay out of the said
Tobacco now in their hands belonging to the said Parish any Law
Statute or Usage to the Contrary in any wise notwithstanding.

And be it further enacted by the Authority Advice and consent
aforesaid that the said Vestry House when built shall be and remain
