To the worpll Commrs of Sommersett County Liber B No.
The humble Peticon of Christopher Nutter Humbly sheweth
That whereas yor peticioner hath been cast in two suits of Law by
one Richard Brittain the one in May the other in July last past 1667
& yor worpll ordered yor peticionr to deliuer a Mare Colte within
twenty dayes after the first Sute, & the Said Richard Brittaine not
Contented with that Colte when pffered according to order did com
mence another sute in July though imperfect agst yot peticionr upon
wch yor worpll granted another order for A Colte of Six mos olld to
be deliuered wch was accordingly don to the great detriment &
Dathage of yor peticioner; And yor peticr humbly Conceiveth tht the
Said Richard Brittain had no Just Cause of Sute agst yor peticionr
at all though he hath been very troublesome agst yor peticioner, for
tht yor peticioner hath performed his bargaine wth the Said Richard
Brittaine & paid him a mare Colt according to agreemt as yor petr
can proue by the testimony of honest Men the Colt being delivered
according to the order of the Said Richard Brittain in Accomack
before he Commenced his sute agst yor peticioner
yor petr therefore humbly prayeth yor worplls that reparacon may
be made by the Sd Richard Brittain for his uniust Molestacon of
yor petr both in dammage & Cost of the two former sutes to the vallue
of eight thousand wt of tobacco beside Court charges yor peticrs repu
tacon having by the Sd Richard Brittain been much endamaged And
yor petr as in Dutie bound shall Pray

foord & upon Non agreemt the Arbitrators to chuse an umphire & a
finall end to make within 2 mos

Septembr in the 37th year of the Dominion of the Rt honble
