72 Kent County Court Proceedings, 1648-1656. Liber A unto moueinge, & ailsoe a Considerable value in hand Receiued, beefore the Assigninge heareof, haue sould and by theese prsents, doe bargaine and sell, unto Seath Foster, his Heires, Executors, Administrators, or Assignes, The one halfe of Poplies Island, and allso the one half e of my land upon the Isle of Kent, unto him & his Heires foreuer, with all the Right & tittle that I my Heires or Assignes haue theare for the one halfe of the prmisses, And for the more securitie, am Content that the Patent or Patents bee made in both our names the said Seath Foster, payinge for the one ha!fe of the Surueighinge or Pattents, or what Charges shall bee Dis bursed for the secureinge of the said Land and moreouer wee Oblidge us our Heires or Assignes, not to Sell or dispose, of any part or psell of the said Land, without the others Consent, and tht in Casse that Either ptie shall sell, that the other ptie is to haue the refusall, twoe Thousand poundes of Tobacc° Cheapper then any other pson, In wittnes wheareof, I the said Thomas Hawkines, haue heareunto sett my hand this 25th day of Januarie 1654 Testus Edward hull Thomas Hawckines Hen vincent 7 Moneth 27 1656 This day Jn° Salter dessired tht the marke of his Cattell might bee Recorded, which is as Fo!loweth, The Right Eare Cropt & ouerkeeld & a holie & the left Eare Cropt & under keeled At a Court houlden for Kent Octohr the 11th 1656 mT Phillip Conier mr Tho: Hinson mr Jos: Weickes mr Morgan prsent mr Tho: Ringgold Capt Russell mr Eliot mr Tho: Hinson plaintife Complaines agst mr Tho: Ward De fendant in an Action of Trespas; That the sd Ward about febr last did pay unto him one hogd of ton, which the sd Ward was debitor, & the sd Hinson did marke it, with his marke & numbr, & left it at the sd Wards house now soe it is tht the sd Ward suddenly after, denied the deliuerie theareof, to the plaintife, who alsoe sent seamen to demaund it, & the lickwise weare denied, soe tht the sd mr Hinson did not only pay dead fraight but lost his market The deposi~ of mr Jos: Weickes aged 36 yers or theareabouts taken in the prsents of the Court sworne Examined & saith That about March last hauinge discourse wth mr Ward about a [ ] of tob tht mr Hinson had weighed & markt at his house, the sd Ward [ ] yor depon tht hee tould mr Hinson, hee should not haue it & further saith not Josh Weickes |
