Kent County Court Proceedings, 1648-1656.61 it bee by due Course of law soe determined. Heareof faile not. Liber A Giuen at Providence Aprill 27: 1656 Will: Fuller To the sheriffe of the Isle of Kent mr Thomas Cole hauinge layd, the afforesaid Attachmt upon part of the Estat of Giles Blake deceassed, hath made his Complaint, tht the sd Blake hired his Sloope & boate flue monethes since, & saild in her to Virginia, & to this day neuer gaue him any accoumpt, and the sd Bleake beinge now decassed, the sloope is left in such Con dition as shee is scarce seruiceable, as the plaintife is Credibly Informd, soc that the none satisfaction for the hire, & the sloope much impecht, is great damadge & yet, more like to accrue, for either hee must loose both the sloope & boate, and all tht belongs to her, or goe himselfe to virginia, to looke after her; 1ff hee goe not hee looses her; If hee goe hee looses his Crope & leaues his family without any, to bee assistant to it, soe tht euery way hee is like to suffer much, if help bee not afforded & the Estate found Responsible, his lose & damadge Considered, hee desires Order agst the Estate, for what hee shall make appeare, by suffissient Euidence, to bee his Just due For the Clearinge of his Complaint to the Court, hee hath produst under the Gouernors hand, as Followeth These are to testifle to whom it may Concerne, that the sloope whearein Gyles Blake did saile, from hence to Virginia, & not yet Returned, did wholly belonge unto Thomas Cole as the pp owner theareof, and this I will testifle if need Require; this of Aprill 1656 Will Fuller The depossition of mr Henerie Carline aged 48 yers or thereabouts sworne Examined and saith That the sloope tht Giles Blake sailed in to virginia from Siuerne sum foure or flue monethes agoe did belonge to mr Thomas Cole, & a boat alsoe wth it, & tht the sd Cole was Owner of the sd sloope & boate, & tht theare was an agreemt betwixt mt Cole & the sd Blake, tht mr Cole for the use of his sloope, & boate, was to haue the one halfe, tht was Erned, by the sloope, improued by the sd Blake, & further saith not Signu Henery Carline H C The depossition of Henery Gott aged 20 yeares or theareabouts sworn Exam & saith That the same tht mr Carline hath Exprest in his Oath yor deponent affirmes with this Addition That the sd Blake was to victualle the sloope & find a man to himself e, to Improue the sloope for the best aduantage, and what was Erned, to bee the One half e to mr Cole & the other to the sd Blake & further saith not The depossition of mr Thomas Cole aged 50 yeares or theareabouts sworne Examined and saith |
