Talbot County Court Proceedings, 1662-1674. 569 Dauid Furbanck Plat Liber BB Ralph Elston defft No.2 Talbott County ss [p. —] Ralph Elston of the County aboue sd plantor was Attached to Answear Dauid Farebanck of the same County Plantr tht he hould couenant to to him Between them made According to the force forme & Effecte of a Certaine Indenture hereof Between them &c: Where upon the said Dauid By Petter Sayer his Attorney Saith that whereas by a Certaine Indenture Made at the Plantacon of Mr John Ander ton December the 21th 1673 Between the said Plat of the one Partt and the said Ralph of the other Part Which other Part Signed with the Seale of the said Ralph the said Dauid Bringeth here in Courtt the date Whereof is the same day and yeare as abouesaid the wch he desieres may be Read and the Plat saith tht allthough he hath full- filled and pformed for Three Munths all and Singulor the Couenants and Grants in the Indenture aboue said & Specified In Fact the same Dauid saith tht [blank] Munthes after makeing the Indenture ahoue said the fore said Ralph Mackanating and fraudelently intending him the said Dauid of the worke he had allready done Subtilly and Craftiely to defraud and deceue agst the Intent and meaneing of the said Couenant and agst all Equitie and Justice forgeing and of himselfe Inventing a Greate many Storries him the said Dauid from the Plantacon of him the said Ralph Contrary to the Couenant hath forewarned and him the said Dauid from Coming to his Crope doth still forewarne Where upon he the said Dauid saith he is damnified and damage to the vallue of three Thousand pounds of Tohacoe and there upon he Bringeth his Suit &c The Flat Dauid Farebancke Proues his declaration by the Oathcs of Jno Anderton and Jno Huntt Therefor the Courtt hath Ordred tht Ralph Elston make present paymt of One Thousand pound of Tobacoe with Cost of Suit William Young Conffeseth Judgmt to Nathã Friare and James Fendleton for flue Hundred and thirty pounds of Tobacoe and Caske The Courtt hath ordred that William young make present paymt of flue hundred thirty pounds of tobb unto Nath Friare and James pendleton with Cost of suite John Driwood Conifeseth Judgemt unto Nath: Frier and James [p.—] Pendleton for Two hundred and forty one pounds of Tobacoe due by Bill The Courtt hath Ordred that John Drywood pay unto Nathaniell Friare and James Pendlton Two hundred and forty one pounds of Tobacoe with Cost of Suite Petter Sides Conifeseth Judgmt to Nath: Friare and James Pendie ton for one hundred and Seauenteen pounds of tobacoe The Courtt |
