Talbot County Court Proceedings, 1662-1674. 559 Bargaine and Agreemen and therefore his Bringeth his suit and Liber BB prayeth Judgmt agst the sd John for the Said Cow with Cost of suit No.2 & he shall pray The Deift John Bradborne Pleded he had Noe Consideracon for the Said Cow: The plat Proues that In Consideracon he past Bi!l for the sd Cow for foure hundred pounds of Tobacoe and that he Was to teach the sd John to Read and writte The Courtt hath Ordred John Bradborne to giue Harbert Croift his Bill for foure hundred pound of Tobacoe wch he the John bath of the sd Herhertt & the said John Bradborne to pay Cost of Suit Or Execution to follow: Tho: Vaghan Plat in a Plea of Case The Plat Declares that the Robert Knape Defft Deift is Indebted the suth of Two hundred and Fifty pounds of Tobacoe for the Smiths worke the Deift proues that he paid the Debt to mr John Pawson: The Courtt hath Ordred that the sd Robert Knape haue a Non sute agst the sd Tho: Vaughan: George Hillston Plat In a Plea of Trespass upon Case The Declara- [p.—] Robertt Knape Deift con Read Talbott County ss: Robertt Knape of this County Planter was Attached to Answeare George Hi!lston of the Citty of London Mariner In a Plea that whereas the afore Said Robert the 20th day of Febuary Last Past aboard the Good Ship Called the Hopwell of London Now Rideing In St Micheals River in the Prouince & County afore Said In Con sideracon that he the sd George att the Speciall Instant & Request of him the Robertt had Sould Bargained and Deliuered unto him the Said Robert Saruants & Goods to the vallue of Three Thousand pounds of good Sound Marchantable Sweet Sented Tobacoe in Caske did assume upon him Selfe the then and there did faithifully Promise tht he Sd Rohertt the afore Said Sum of good Sound Marchant Sweet Sented Tobacoe and Caske to him the Said George when he Should be thereunto Aifterwards Requiered would well and faith fully pay and Content yett the afore Said Robertt his promisse and Assumption Little Regarding but Plotting And fraudelenly Intend ing him the said George of the afore said Suth of Good Sound Marchanable Sweet Sented Tobacoes According to his Promiss & Assumption hath Not paid Butt the Same to him heitherto he hath Alltogather Reffused and yett Reffuseth to the damage of him the Said George three Thousand pounds of Good Sound Marchantabi Tobacoe and Caske & hereupon he Brings his Suit &c The deff: Pleads he hath Paid the debt and taken in his Bill The Plat Saith tht he hath his Bill in But it was by Defraud & decept for he was to haue by his Bill good sound sweetsented tobacoe without Ground leues or Seaconds the Deffet Answereth the had yew of his |
