John Dabb demds wart versus John Gibson in an Act of Debt by bill 300lb of Toil for this he bringeth his suyte Tho Hinson Plant Jon Deere Deift The plant demands in Chanciry a Debt or some of Tobaccoe wch he had payd Formerly to the Defent For the use of Mrs Marsh, & prtends the Deft had noe such Debt due to him, wch Toil was about the some of 900lb The Deffendt saith it was a Just debt & nothinge but his due what hee had From the Plant, And Craues a refferance to the next Court to bringe in his Testimony & the Coppie of an order of Court relateinge to the Cause. The Court doth grant a Refferance, & order That if the said Deere shall not make his Appearance to Answar the suyte at the next Court That then the Debt wch mr Hinson payd the Deffendt hee shall be lyable to satisfie & restore againe wch was about nine hundred Pounds of Toll.
