Liber D the sharers wch the Deft puts on the Plant. the plt desires to beare but
his owne pt,
The Deft saith tht he beinge to depart from thence, market out his
owne pt of the Toil & alsoe the part belonginge to the Plant Robt
Knapp, wch then was in Caske, & there remained then Due to the
Plant Forty Fower Pounds of Toil the Plant then assigned ouer
to Hasadia Hill, And Further the Deft ThO Hinson protests he
mayd noe distinct choyce to take the best toil.
The Court haueinge debated the Matter in this Cause Findeth noe
cause of suyte, & that the Plant shall pay Court Charges else Execn.

The Plant demands a debt of 400lb of Toil, wth Caske the Deft
ownes that he owes him the sd Matthew Reade three hundred eighty
one Pounds of Toil the ptyes agree on this some & if they Finde the
Debt more when they come to Ac° to allow of it The Court doth
order prsent paymt of the debt confest by the Deift unto the Plant wth

of Tob with Caske The Deift Confeseth the Debt to be just: The
Court doth therefore order that the Deft John Smith to make prsent

Upon a Refferance granted last Court to the Plant to proue his
Charge against the Deft & his euidenc beinge brought into Court,
The Court debateinge the matter & findeinge that the Euidence wch
are John Deere & his wife, to be ptyes wth the Deift in this Cause,
doth not apprehend it Lawfull or Equitable to tender thm their oathes.
The Court not Findinge any positiue Testimony to proue the Deft
guilty, doth therefor see noe Juste cause of suyte, & doth Order that
the Plant Tho Bradnox shall pay cost of suyt, wth Damages else
