162Kent County Court Proceedings, 1656-1662. Liber B doe giue unto the aboue sd Margret winchester wth all her Female Increase to her, her Heires & assignes for euer & the male Increase to John winchester her Husband.—this was Acknowledged in open Court. Test me John Cowrsey Clar: Know all men by theis prsents That I Thomas wetherill of the Isle of Kent doe Acknowledge to haue sould, Bartoured, Barganed, & mayd sale, unto John Dabb of the afore sd Island Fowerteene head of Cattle (viz:) three Cows two Steeres of fower year old, two steeres & one Bull of three yeare old, six younge Cattle of one yeare old, And likewise the aforesd Wetherill doth acknowledge to haue sould unto the aforesaid Dabb all the Right, Clame & intrest That doth belonge unto the afore sd wetherill, of a plantacon that the afore sd Dabb is partner wth the sd wetherill in the said Land, which con tames one hundred Acres of Land, wch I the said wetherill doe engage and binde my Execrs or Assignes to make a full confirmacon to the said Dabb, his Execrs or Assignes of the afore sd Land by Assignemt upon the Pattent, or in any other kinde, if the said Dahb shall have cause to require the same tht may be accordinge to Law: which f ore [lot. 56) said bargan & sale of Cattle & Land as is Exprest aforesaid, I the sd Thomas wetherill doe acknowledge to haue barganed & sould, by me & from me my Heires Execrs Adtninrs or Assignes foreuer, unto the aforesd John Dabb his Heires Execrs Adminrs or Assignes for euer, wth all the Rights a priuiledges there unto belonginge peacably & quietly to keepe & posses & enioy as his owne proper goods, wch I the said wetherill doe binde my selfe my Execrs or Assignes, to saue harmlesse & keepe Indempnified the sd Dabb his Heires ExecTs Ad minrs or Assignes from any Just Clame or molestacon of any pson or psons whatsoeuer In Consideration hereof I the aforesd Dabb doe binde my selfe my Execrs or Assignes, to pay or cause to be payd unto the aforesaid Thomas Wetherill his Execrs or Assignes, the Just Some of Tenn thousand th of good well Conditioned Tob & Caske, to be payd upon the 10th of Nour in the yeare of our Lord 1640 And soe yearly the Just some of one Thousand pounds of Tob & Caske, p yeare untill the aforesaid some of Tenn thousand pounds of Tob be Justly & fully satisfied, And to the well & Just pformance hereof, I the aforesaid Dabb doe binde ouer for security unto the afore said wetherill the afore sd quantity or Just Nombr of Cattle accordinge to their age, And likewise the aforesd Land, And to the Juste pformance here of we haue interchangably set our hands & Seales this 16th of Feb 1658 Thomas Wetherill seale Witnesse Josh: Wickes his marke John Cowrsey the marke of seale John Dabb Acknowledged in Court by both ptyes.
