We are of Opinion that the Business on which you require our
Opinion in your Paragraph to Mr Chases Letter of this Instant, lies
with the Intendant of the Revenue — and that we cannot with any
Propriety give an Opinion, the Law having vested him with the Sole

Agreeable to the Constitution and Form of Government the Coun-
cil Proceeded to the Choice of a Councillor in the room of Gabriel
Duvall Esquire who has resigned when James Brice Esquire was
proposed ballotted for and elected
The Council adjourned 'till Tuesday the 3d of August next

Ordered that the western shore Treasurer pay to James O'Hara
a Blind soldier three Dollars allowed him by this Board in Virtue
of a Resolve of the Genl Assembly of July 1779. —

Sir
I am much obliged to the Council for the Honor they have done
me in choosing Me one of their Board, and must beg the favor of
you to communicate to them my refusal of the Appointment as I
cannot with any Degree of Consistency accept thereof I am Sir
with great regard & Esteem
