versant with Court Proceedings, has a large family and is not able
to Pay the Forfeiture. From our knowledge of the man and the best
information we can get, we believe the within representation of his
Case to be strictly true and that he has innocently subjected himself
to the Forfeiture. These Considerations have induced us to recom-

mend him to your Excellencys Clemency, and to request that the
whole of the Forfeiture may be remitted, the Costs necessarily
attending the Execution being fully sufficient to impress him with
the necessity of a formal Discharge from Obligations of this
nature.

In Council 16 August 1782

Whereas Henry Miller of Frederick County on the 24th of Feb-
ruary 1781 was recognized by Philip Thomas then one of the Justices
of the said County in the sum of one hundred Pounds specie for
Hugh Kelly's Personal appearance at the then next County Court
to be held for the said County and Whereas the said Hugh Kelly did
appear at the said next County Court but no evidence appearing
against him the recognizance was respited from Court to Court until
March Court last when neither of the Parties to the said Recognizance
appearing it was forfeited and Whereas the said Henry Miller by his
Petition to this Board sets forth that he was ignorant of the mode
to be pursued for his own Discharge from the recognizance and
apprehended it was complied with by Kellys appearance and never
knew or heard it was continued on the Docket and Kellys further
appearance necessary until the Sheriff served an Execution on him
and Whereas five of the Magistrates of the said County have certified
that they believe the Case as represented by the said Miller to be
strictly true and recommend that the whole of the forfeiture may
be remitted. On Consideration of the Case of the said Henry Miller
we do remit the said forfeiture of one hundred Pounds specie as it
was incurred not from any Crime of his own nor from a Contempt
of the Court but from a neglect proceeding from his ignorance of
the mode to be pursued in such Cases and do direct that on Payment
of the Costs the said Henry Miller be discharged from the Execution
for the said one hundred Pounds specie.
