August Court next. That a Robert Johnson was likewise on the said
24th Day of February 1781 Recognized by the said Philip Thomas
in the Sum of fifty Pounds specie for his appearance at the then next
County Court to be held for the said County of Frederick to Testify
on Behalf of the said State against the aforesaid Hugh Kelly and
not to depart etc. who also appeared but (from my memory) not
before the Grand Jury were discharged, which occasioned as well
his as the aforesaid Recognizances to be respited, and he neglecting
afterwards to appear his recognizance was respited from Term to
Term 'till march Court last when it was also called and forfeited and
Execution hath likewise Issued returnable to August Court next.
And that no Information or Presentment hath been made or is
depending on behalf of the State against the said Hugh Kelly for
any Criminal Matter in Frederick County Court since the Date of the
Recognizances aforementioned.
As Witness my Hand and seal of Office this 27th Day of July

The following Petition was presented to the Board by Henry
Miller.

To his Excellency Thomas Sim Lee Esqr Governor of Maryland.
The Petition of Henry Miller of Frederick County humbly sheweth
That your Petitioner became bound in Recognizance with a certain
Hugh Kelly in the sum of One hundred Pounds specie each for the
Appearance of the said Hugh Kelly at March Court 1781. That the
said Hugh Kelly appeared and attended at that Court and your
Petitioner ignorant of the mode to be pursued for his own Discharge
from the Recognizance and not knowing that it was continued from
that Court, apprehended it was complied with by Kelly's appear-
ance; and never knew or heard that it was continued on the Docket
and Kellys further Appearance necessary, until the Sheriff of this
County served an Execution on him for the recovery of one hundred
Pounds returnable to the next August Court.
Your Petitioner humbly Prays that the forfeiture may be remitted
him, as it was not incurred by any Crime of his own, but a neglect
proceeding from his being unacquainted with the mode of discharging
himself at the Court to which the recognizance was returned and
as the Public have received no loss from that involuntary neglect, the
Principal not being presented or any Prosecution instituted against
him. And your Petitioner as in Duty bound will pray.

The Subscribers Justices of Frederick County Court beg Leave to
represent the Case of the within Petitioner as one deserving your
