That the pay of Capt Walley commanding Officer of the Barges
be twenty Pounds.
That the Rank of the Captains be as follows, Walley, Dashiell,
Frazier, Spedding.
That Capt Walley shall be indemnified by the State in case a
Cannon which is private property & the small Cutter should be
lost.

[Council to Capt. Zedekiah Walley]
The Object of your Equipment is, to protect our Bay Trade, or
to defend the Citizens of the State and to cover such of their Property
as lies exposed. The Commanding Officer of the French Marine at
York in Virginia having, on Application of the General Assembly,
promised to furnish some armed Vessels to co-operate with and cover
our Barges; to carry this Object into Execution, you are immediately
to proceed to that Station, and apply to him for Orders, and in all
Instances of Co-operation and joint Enterprize, you are to hold
yourself subject to his Direction and Command, or the Command
and Direction of such Officer as he shall appoint to command on the
said Cruize; But if particular Circumstances, in the Opinion of such
Commandant, or Officer, should require a Separation of the two

Forces, our Barges and their Operations are then to be under your
sole Direction, until further Orders from the said Commandant,
whose future Orders, whenever he may think a joint Enterprize
necessary, you are to consider yourself subject to : It is however, to
be understood, that your Operations are not to be extended beyond
the Capes of this Bay, unless on Pursuit of the Enemy, a Probability
should appear of capturing them, and as soon as such Prospect
ceases, or the Capture is effected, you are to return back to the Bay,
within your Limits. The Officers and Men of the Barges, are to be
subject to the last Articles established by Congress for the Govern-
ment of the Navy of the United States, with which you shall be
furnished, as soon as we can obtain them. You will transmit to us by
every good Opportunity, Journals of your Transactions, and regular
monthly Returns of your Men, distinguishing between the Effectives
and non-Effectives. Mr Paca, under whose Direction a Magazine will
be established at Snow Hill, will take Care that you have proper
Supplies of Provisions, Ammunition, and Hospital Stores. As for
the Hospital, that must be fixed at such Place as the Doctor, with
your Concurrence shall judge most convenient.
