The following Message is sent to the Lower house by Daniel
Dulany Esqr
By the Upper house of Assembly 23d December 1747
Gentlemen No man in this Province can be insensible of the
unhappy Situation of it, and that the Conduct of some Merchants
has Contributed very much to the Misfortunes We Labour Under,
by their Misapplication of the Money which many of the Inhabi-
tants of this Province had the Misfortune to intrust them with The
Sufferers in hopes of Recovering at least some Part of what they
have been Defrauded of, sued out Attachments as their only Remedy
in View of Geting some of the Merchants Effects in the Country
wherein some have succeeded but many more have only added to
their first Loss, by Runing themselves to a Great and fruitless Ex-
pence; Those who have had any Success are threatened to be called
to a severe Account for daring to meddle with the Effects of a Mer-
chant, who, in Violation of the trust reposed in him, has Converted
money to his own Use, which was Lodged in his hands, with Direc-
tions to Dispose of it in a Particular Manner for the Benefit of those
it belonged to; and a new Doctrine is attempted to be introduced
that the Effects in this Province, belonging to a Merchant who never
was here, are not Subject to any attachment
We are informed that they do not intend to Stop here, but are
resolved to apply to the Parliament for an Act to screen and secure
all their Effects in the Plantations from all Kinds of Process; and
if they should Prevail we must be entirely at their Mercy; And there-
fore that we may not be wanting to ourselves in doing all we are
able to avert the impending Danger; in Order to which, We pro-
pose to send a fair State of our Case to his Lordship and an Address
to him to oppose any such Act pasing; and that we may Save Time
as much as Possible, we will either send you the Case and Address
for Your Consideration, or some of our members will Confer with
such of Yours as you shall appoint, on the Subject

May it please Your Honours In Answer to Your Message of
this Day by Daniel Dulany Esqr this house having Determined not
to undertake any new Business, have referred the Consideration
thereof to the next Session of Assembly
