To the hon^ble the Gouerno^r & Councell The humble Petⁿ of
Thomas Dauis. Sheweth
That whereas one Elizabeth fframe, yo^r Pet" seruant, did in
Decemb^r last sue yo^r Pet^r for her enlargem^t Alleaging th^t shee the s^d
fframe was ffree: Att w^ch Court, it was ordered th^t the s^d fframe was
to bring proofe of her s^d ffreedome, att the Court in March next
following, otherwise to make good, such dammages to yo^r Pet^r as yo^r
Pet^r should then make appeare th^t hee had susteyned. And the s^d
Elizabeth hauing not made any thing appeare, yo^r Pet^r humbly
craveth the benefit! of the s^d Order. And th^t the s^d Elizabeth may by
Order from this Court be restored to yo^r Pet^rs seruice, to serue ac-
cording to her Condicon or Indenture, Crauing Costs of suite, &
Consideraon for her absence, & losse of time, as this Court shall
thinke meete.
And yo^r Pet^r shall pray &c :
Know all men by these p^ents th^t I John Hawkins of New England
Marriner haue sold unto Thomas Dauis One Mayd seruant for three
yeares, her name is Elizabeth fframe & shee doth promise & bind
hcrselfc to serue the s^d Dauis, his heyres or Assignes truly, the full
tearme of time aboue mentioned, & for the true p^eformance hereof,
the sayd Hawkins is to giue her a Cow Calfe, as speedily as hee can,
& to the true p^eformance hereof wee haue hereunto sett o^e hands,

Uppon the Petⁿ of Thomas Dauis agst Elizabeth fframe. The s^d
Dauis alleaging th^t the s^d Elizabeth had time remayning of her
seruice to him. Elizabeth the Deft replyeth th^t she hath not re-
ceaued of her master according to Couen^t & further th^t shee was a
seruant, when shee made That latter Condicon w^th the s^d Dauis, as

appeareth by the Oath of Adam Staueley uerifying the same uppon
Oath in open Court. The Court therfore Judgeth th^t the s^d Elizabeth
bee sett free from the s^d Dauis, w^thout further Obligaon of Seruice.
And the s^d Dauis is left to have his dammage agst John Hawkings,
who made the Condicon. Concerning the s^d Elizabeth, w^th the s^d
Dauis, & Soe Ordered accordingly.
And the s^d Elizabeth Clayming Cloathes according to the custome
of the Country. It is Ordered likewise th^t the s^d Dauis shall pay
her Cloathes, according to the Custome of the Country, uppon
Demand, as being her last Master.
