Custome of the Country; w^ch Condicon is allready performed by
him, as hee alleageth. And the plf likewise confesseth that the Deft
hath tendred him a Boy; w^ch Boy hee shewed in Court. The Court
thereuppon Ordered that the plf receaue that Boy now tendred him ;
& th^t the dft bee discharged from his s^d Obligaon.

Roberts v.
Hambleton

Uppon the Petⁿ of Margarett Roberts plf agst John Hambleton
deft. The plf in her Petⁿ alleageth th^t shee is free, & th^t her Master
seeks to detayne her, & make her serue longer time; & w^th all uery
often striketh her. All w^ch the deft denyeth, & desyreth Respite till
next Court to proue his allegadn. And the Court Ordered that this
Cause bee respited till next Court, & the plf to returne to her Masters
the defts howse & there to Hue till next Court as afores^d The deft
is likewise charged th' hee use her well & not strike her. And if soe
bee, the plf att the next Court be adiudged free, the deft her Master
is to pay her dammage & consideraon for this her time of Seruice.

Ouerzee v.
Cornelius

Uppon the Petⁿ of Symon Overzee plf, agst John Cornelius deft,
for fiueteene hund^d pownds of Tob, due by Bill, & his owne proper
debts, & Three Thowsand nine hund^d more by assignm^ts from M^r
Emperour, and Cap^t Will^m Euans. The deft sayth th^t he hath
satisfyed some small thing of his owne proper debt, due to the plf,
& as to the assignm^ts that they were deliuered & made ouer w^thout
his priuity & consent. The Court Ordered th^t the plf satisfy unto
the deft Thirteene hund^d pownds of Sweet sented Tob, w^thout
grownd leaues in Cask, & one hund^d fifty six pown^ds more for
dammage (as his owne proper debt) of the like condiconed Tob.

Ashcomb v.
Johnson

Gwy White examined Sayth uppon oath, th^t M^r John Ashcomb
sold a Cow unto Cornelius Johnson. W^ch uery Cow hee the Ash-
comb sold againe to Abdelo Martin & further sayth th^t M^r Ashcomb
profered to sell that Cow, to him this Depon^t. Ishmael Wright
examined sayth uppon Oath, that Abdelo Martin to this Depon^ts
knowledge went ouer to M^r Ashcombs, to desyre a release from a
Bill wherein hee was ioyntly bownd w^th his mate Cornelius, for a
Cow unto the s^d Ashcomb. W^ch the s^d Abdalon not effecting the s^d
Abdalon came to a new agreem^t w^th M^r Ashcomb concerning th^t
Cow, & bought her wholly to himselfe, & passed his Bill to the s^d
Ashcomb for th^t purpose, as the s^d Abdalon told this Depon^t
Uppon the demand of John Ashcomb plf, agst Cornelius Johnson
deft for Seauen hund^d pownds of leafe Tob. w^th Cask, due by Bill,
The deft acknowledgeth it to bee his Bill. It is therfore Ordered, th^t
the deft satisfy Seauen hund^d pownds of Tob & cask, (as hee hath
acknowledged) uppon demand.
