Present as Yesterday
The following Message is sent by George Plater Esqr

By the Upper House of Assembly 22d April 1735
Gentlemen.
In answer to your Message of yesterday by Mrs Key and Hemsley
relating to the 3d p hhd raised between 29th Septemr 1732 & 29th
September 1733 We say that altho there is not any present Occasion
for using that mony (yet considering the present State of Affairs
in Europe) We know not how soon there may & as the present Stock
of mony for purchasing Arms &c is but small We ought in Prudence
to make the best provision We can against any Accident that may
happen; besides his Excell having communicated to us a Message
which he has prepared to your House wherein he seems desirous to

have the mony applied to the uses It was intended for. We there-
fore hope your House will prepare a Short Bill to apply it accord-
ingly

The following message with the Bill for ascertaining the Gauge
and Tare of Tobacco hhds is sent by Philip Lee Esqr

By the Upper House of Assembly 22d April 1735
On reading and considering your Message yesterday by Messrs
Hooper and Smith relating to the Bill for ascertaining the Gauge
and Tare of Tobo hhds We observe that the reason you give for not
inserting the Paragraph proposed by Our house obliging the mas-
ters of Ships and Other Sea Vessels not to take on Board any hhd
3r hhds of tobo exceeding the Gauge in the said Bill mentioned, is,
because you presume that many hhds already made packed and prized
do exceed that Gauge whereunto We answer that the Time given till
the 29th September next is long enough for any such tobacco to be
Shipped of, And therefore We cannot think of the reason afd Suffi-
:ient to hinder the adding that Paragraph to the Bill especially Con-
sidering that a fine imposed on the masters for taking on board any
hhds above the Gauge will certainly be the most effectual means to
under any Person from exceeding it. Wherefore we must Still
nsist upon that Addition to the Bill And We must further observe
to you that the same Reason insisted on by your House is much
stronger against that part of the Bill relating to the Inhabitants of
