2dly That the Colonel Lievtenant Colonel Majors and Captains
have it in their Power to deliver Arms to such Persons as they shall
think proper.
3dly That a Clause be Added to prevent listing Servants amongst
the Militia; unless upon an Emergency to be judged of by the Field
Officers.
4thly That the Fees of the Sheriff for Execution in Complyance of
this Act be thirty Pounds of Tobacco beside Imprisonment Fees and
the Clerks Six Pounds of Tobacco for Issueing Execution, and that
the same be levyed on the Body Goods &c of the Offender
5thly That the Colonel of the Several Counties be Obliged to return
to His Excellency the Governor or Commander in Chief, a List of
such Arms as are lodged in the Several Counties, with the Condition
they are in
6thly That no Officer be made lyable to pay for any Arms where
the Person intrusted with them shall lose sell or destroy them and
prove insolvent, or run away, or die insolvent,
7thly That Provision be made that the Arms be all Marked and a
Penalty laid upon any person that shall sell or dispose of any Pub-
lick Arms and likewise upon any Person that shall purchase any
knowing the same to be such,
8thly That Provision be made that no Member of the Upper House
of Assembly be Obliged to serve in the Militia.
All which is Humbly Submitted to the Consideration of Both
Houses.
