therefore Desire that the Gent that are to be appointed of your
house may be nominated that they may proceed thereon, and
therefore have appointed Mr Philip Lee, Coll John Mackall Mr
James Smith Coll Roger Woollford Majr Richard Colegate
and Mr James Lloyd to joyn Immediately with such Members,
as your Honours shall so nominate.

And sent to the upper house by the Gent appointed
They return and Say they Delivered it.
The following Message being prepared (Viz)

By the Lower House of Assembly

April 22. 1720
May it please Your Excellency
Mr Speaker haveing communicated to this house your Ex-
cellency's Letter of this Day have reassumed their former
Vote on the three pence p Ton & have Resolved Nemine Con-
tradicente that your Excellency has a good Right to the said
three pence p Ton so long as you shall Continue Governour of
this Province

And sent to his Excellency by Mr Tyler and three others
They return and say they Delivered it.
The following Message being prepared Viz:

By the Lower House of Assembly.

April 21st 1720.
May it please your Honours

It has been the Opinion of this house hitherto from Generall
Causes that this Sessions would not have Continued so long,
Considering there was but Little Publick business then before
us so that from thence we reasonably might (in favour of the
parties petitioning) be willing to refer the further Considera-
tion of that affair till next Sessions rather than Surprize them
by so Speedy Determination which we take to be the reason,
and cannot conceive that any Construction could be made of
our pretending to the right of Determining the Duration of
the Sessions, which was never Intended by us, for we allow
his Excellency has the only prerogative under his Lordship to
Determine the Same.
