consequently might be Surprized should we Assent to a De-
termination as prayed, for which reasons we are Sorry we
Cannot Come into the Measures proposed by his Excy & your
Honrs

To which last foregoing message by Mr Tyler & Mr Lee
the following Message is prepared Viz.

By the Upper House of Assembly

Aprill the 14th 1720
Gentl. So farr as your message by Mr Tyler and Mr Lee
relates to the redressing any generall Aggrievance or to the
hearing the Complaints of pticular psons that have not a
Right to another kind of Judicature, We intend not to Inter-
fere with the proposalls of Your House but so far as the
Subject matter thereof relates to the Conduct of a Member of
this house in the Execution of a Comission from the Govern-
ment It seems to be the more Rightfull Province of his Excy
And this House to Consider thereof. But least there should
be any Misapprehensions Betwixt the Two Houses on this

Occasion And for that Preservation of a mutuall Respect and
good Agreement betwixt them we propose that you Joyn some
Members of your house that are not Interested in the Affair
to Conferr with Phil Lloyd Esqr Col Matt. Tilghman Ward
and Tho. Bordley Esqr of this House in the Conference Cham-
ber about the Subject Matter touched on by your above men-
tioned Message

The above Message Sent to the Lower house by Col. Hol-
land Col Young Esqr Hall Esqr Lloyd Esqr Lowe Col Ward
and Esqr Bordley, who return & Say they delivered the same.
A Bill for the Relief of John Howard &c. being read, Thos
Bordley Esqr on his motion is Admitted as Councill to Speake
to the afd Bill. And the afd Bill is thus Endorst Viz.

By the Upper House of Assembly
Aprill the 14th 1720
Read the first and Second times & will pass
Signed p Order John Beale Cl Up ho.

And Sent to the Lower House by Esqr Bordley who returns
and Says he delivered the same
