332 Assembly Proceedings, May 14- June 6, 1719.

By the uper House of Assembly
May 30th 1719
Read & will pass with a Clause to be Added, Oblidging the
Debtor or pson Taking Advantage of that Law to Declare
upon Oath before one of his Ldship's Justices of the Provll
Court or two of the County Court that he hath not nor had
at the Time of his being Taken in Execution the Particular
Specie for which He was psecuted and then under Execution,
or any part thereof more than what he will pay to his Creditor
if he think fitt to Accept of it And that if any Such pson so
Taking Advantage of that Act and Purging himself upon
Oath as afd shall be Convict of forswearing himself on that
Occasion, he shall be Adjudged Perjured & shall undergo the
like Pains & Penaltys as any pson Convict of willfull &

Corrupt Perjury.

Wee have Considered Your Message by Col Addison of this
Day And also the Right Honble the Lord Guilfords And his
Excy the Govr Recommendation of a Law to be past in favour
of Mr Humphreys & shall always be Glad of an Opportunity
of Oblidging Either of them in the Service of their Friends
where it may be Done without Runing Counter to the Laws of
the Country that have hitherto been well approved.
But we find the Only Intention for the Act for the Advance-
ment of natives & Residents of this Province was to Prevent
those from Offices that had Interest Enough to get them, for
those that have none needed not to have been Provided against
by a Law & if those that have Interest Enough to gett Offices
may as Easily Obtain a Dispensation in Vain was it made
nor do we find there ever has been above One such Instance
thro the Course of any One Govrs Adminrcon which has already
been given in favour of Mr Steele.
Wee therefore hope his Lordship & his Excellency will not
take it amiss that we adhere Strictly to the Law as it now
Stands. And having as we Conceive more of the youth of
the Country now Qualified for Offices than formerly and a
fair Prospect of their Increase by the Care that is taken to
