untill the 29th Sepr following, And was to be paid to the said
Lord Benedict on the same Consideration
I Do Certifie hereby unto your Honrs all that Occurs to me
upon that Subject, Viz. That the Lord Benedict dying soon
after his Father Could have no knowledge of that Law and
therefore could neither have Declared his Acceptance or
refusall thereof that the I2d raised by Vertue of that Law has
been by me remitted for England and such pportion thereof
as became Due since the Death of the Lord Charles And untill
the Death of the Lord Benedict has I verily believe been
accounted for to the Exrs of the said Lord Benedict an Exact
Computation thereof being by me laid before the Exr of the
said Lord Charles And the psent Lord Baltimore.
That the Exr of the said Lord Benedict has fully impowered
me to receive and take into my hands all the psonal Estate
whatsoever that was of the said Lord Benedicts in this pvince
at the time of his Death And Pursuant thereunto I thought
it Just and reasonable to Accept of the half years rent due to
the Lord Benedict in Tobo at 2d p Ib & have recd some small
part thereof at the same rate and shall Continue to receive the
remainder in like manner because the Consideration for so

Taking it (Viz the I2d p hhd) was by me recd remitted and
accounted for, for I should think it a great hardship that the
Consideration mony should be paid by the Country & trade
and the Condition of the said Consideration not pformed I
believe the Honble House is sensible that a great many of the
Inhabitants of this pvince by Attachments Condemnations
and Executions have been Compelled or are like to be to pay
the Rents in mony According to their Patents whereby they
have no Benefitt of the I2d so as afd paid how agreeable to
equity and Justice is Submitted to Your Honrs prudent Con-
siderations by your
Honrs most Humble &
most Obedt Servt
May the 7th 1718 Charles Car roll.

The following message being prepared is sent to the Lower
House

By the upper house of Assembly
Gent. May the 7th 1 718
On reading of yesterdays Message by Coll Maxwell & two
others his Excy observes to this House he has no Direction
from their Lpps abt the Councill's being Joyned to the Keeper
of the Great Scale for the Time Being to sitt as a Court of
Judicature And have a Voice in passing Decrees or other
