the said Bell to appear here for his Contempt being four
Days at Ten Shillings p Day.
Resolved that Thos Macnemara Esqr Naval Officer has
taken Exorbitant fees from Capt Pulsifer and that the sd
Pulsifer hath his Remedy at Law against him for the same
The following Message being Prepared by this House is
sent to the Lower House Viz.

By the Upper House of Assembly
May the 7th 1718
Gent. Mr Thomas Macnemara having been sent for by his
Excy to Appear before this House to know whether he has
any thing to offer on a lettr sent him by the Lord Guilford
and Baltemore Inclosed by their Lordships to his Excy And
Being asked by his Excy whether he had any thing to offer him
by the Command of their Lpps, sayd He had not. But that
their Lordships lett him know his Excy was to make Proposals
to him and being further asked whether he had made Appli-
cation to his Excellency since He had recd that Letter, An-
swered he had not which his Excellency says he takes to be a
further Confirmation of his Obstinacy and Contumaciousness
he then makeing no offers of his Submission on the Order oi
his Suspention in the Chancery Court Notwithstanding their
Lpps have Approved that Suspention by their Letf to him on
Reflection whereof this House take into Consideration Mr
Macnemara's Behaviour to his Excy in Perticular not only By
affronting as Govr and Chancellor which may Appear by Two
Indictments found agt him in the Provll Court of this Province
but Endeavouring to get him moved from his Government
which he had the Confidence to Own to his face in the Court
of Chancery He had done to the utmost of his Power, But

also to the Govr and Councill comparing them and their p ceed-
ings to the Spanish Inquisition, And the Contempt and the
Indignity which he had frequently offered to the Provinciall
and other Courts in this Province in the Speciall Court of
Oyer and Terminer for the Tryall of those psons Appre-
hended for firing the Great gunns on the Birth night of the
Pretender He said lett me see who dare try them by this
Commission or words to that Purpose having offered a Cer-
tiorari to Remove it to the Provll Court for Allowance which
was Denyed. This House thinks themselves Obliged in Jus-
tice to his Excy's Character and for Encouragment and Sup-
port of the magistrates in the Distribution of Justice to declare
the said Mr Macnemara a Contemner of Authority And a
Disturber of the Peace & Tranquility of the Good People of
this Province And therefore Earnestly recomend it to You
