The Question being put whether there is any thing Con-
tained in that Act that Can be deemed or Construed to Extend
that the Trusts Authorities or powers granted between man &
man in their private Transactions is affected thereby. Tis
Answered by this house nemine Contradicente That no Trust
Authority or Power between man & man in their private Af-
fairs is Affected thereby.

Hall. Viz.
By his Excellency in Council, May 29th 1717
Gent. I have herewith sent you for your p usal An Article
of their Lordships Instructions to me relating to Ordinary
Lycenccs which is as foll.
Article 11th Whereas the granting Ordinary Lycences is
undoubtedly in us And that we have Impowered our Secretary
Mr Tho5 Beake & Mr Charles Lowe either by themselves or
their Deputy to grant them & to receive the fines thereof to
their own use, And thinking it necessary that the Ordinaries
in our Province should be regulated we are desirous that a Bill
may be prepared accordingly And the fines thereon may be
made Certain which you are to Endeavour to Accomplish
being rather Inclined to have it settled with the Consent of
our people than by our own Prerogative.
