The Petition of St Marys County praying an Act to revive
the Process of their County Court was read & recommended
to the House of Delegates and sent them together with
Henry Mudds & Matthew Mason's Petition by Col Ennalls
The Houses Message by Col Lowe Mr Ungle Mr Hudson
and Mr Robins being taken into Consideration the following
answer was sent thereto by Col Greenberry & Col Tilghman

By the Council in Assembly
October the 25th 1711

Since we have so often lett you know we cannot advise the
Presidt to act any thing contrary to her Majesty's Instructions
we admire you should now insist upon Regulating the Act
for limitting Officers Fees having formerly agreed to refer
that Matter to the Arrival of a Capt Genl which as it cannot
be Expected will be long so It will also be the most proper
and convenient time to Settle those fees. And therefore we
propose that the Law be reenacted as heretofore least for
want thereof the officers be obliged to prosecute Actions for
their Fees to the great oppression of the good People of the
Province
We cannot consent to any regulation of that Law at this
Time & therefore think it will be to no purpose to spend time
in Conference thereon

Mr Macall Mr Roberts bring from the House of Delegates,
Mr Joseph Lamberts Petition and the following message Viz.

To the Honble Robert Bradley Esqr & the rest of the
Honble House of Assembly

The Humble Petition of Joseph Lambert
Humbly Sheweth
That your Petitioner being the only surviving Executor of
the late decd the Reverend Mr John Lillingston cannot in
Conscience but represent to your Honours the great Loss
that the orphans of the said Mr Lillingston Sustain by being
denyed the 40 p poll for that year Viz. 1709 in the which It
pleased Almighty God to call their Father to his Everlasting
Rest
It is well known that the sd Decd Served in the Parish of
St Pauls many years before there was any ministerial mainte-
nance Established in the Province In which Time he could
scarce acquire the bare necessarys of Life for his painful &
faithful Labours. And since the Establishmt of the 40 p poll
