The Upper House. 367

Thursday June the 29th 1714

The Honble her Majesty's Council Sate in Assembly Pres-
ent as Yesterday
Mr Tyler and three more of the Delegates brought up the
following answer from their House to the Proposal made
yesterday that our Agents should procure the opinion of some
of her Majesty's learned Council at Law and two other Emi-
nent Lawyers whither the Statutes of England which are not

U. H. J.

local but seem General are in force in this Province or not Viz.

By the House of Delegates
June the 29th 1714

To his Excellency the Governeur & Council in Assembly
We are of Opinion your Message of the 28th Instt by the
Honble Col Wm Holland and Col Samuel Young is a thing
worthy of our Consideration. But as we are desirous to put
an End to this Session the Time of year being very incon-
venient for revising our Laws, And that we believe the
Examining the Statutes of England will require more time
than our urgent Occasions att present will admitt us to bestow
upon it have referred the same to the Consideration of the
next Sessions of Assembly to which we pray your Excellency's
& Honour's Concurrence
Signed p order M Macnemara Cl Ho Del.

In answer whereto the following Message was prepared

By the Governour & Council in Assembly
June the 29th 1714
Gentlemen —
Upon reading your answer to our message of the 28th June
by Col Holland and Lt Col Young relating to some Statutes
of England we have reason to believe you have misconceived
our proposal therein. By which we did not offer to you that
this General Assembly should Concert what Statutes should
be in force here. But that the Question should be Solely
Stated to the Lawyers in England to know whither the said
Statutes should be in force here or not they being often As-
serted as Law & very often denyed Which introduces very
great Doubts & Confusion in the Courts of Justice here.

p. 914

We do agree with your House that the Time of the year
doth not well admitt you to be long absent from your respec-
tive Habitations and therefore shall readily concur with you
in the Speedy Conclusion of this Session
Signed p order W Bladen Cl Coun.
