The Upper House. 365

And thereupon was informed that the several Sallarys and
Allowances are ascertained by an Act of Assembly made
therefore

His Excellency is pleased to ask if Justice be well admin-
istred in the Several County Courts and whither some of those
Courts have not delayed to dispatch the Causes before them;
Is told there have not been any Complaints of that Kind save
of one or two County Courts in the whole Province
His Excellency proposes to the Council whither It may not
be fit a Letter be wrote from this Board to the Several County
Courts to certifye to his Excellency what Causes are depend-
ing before them and why they are not Expedited

U. H. J

Which is thought very reasonable & Ordered that such
Letters be wrote
His Excellency is further pleased to propose whither It may
not be reasonable the Clerks of the Several County Courts in
this Province should not be obliged once in the year to send
his Excellency Copys of the Judgments and Proceedings of
their Courts

The Board do think if the County Clerks send Copys of
their Doggetts It may suffice with the reason of their Several
Continuances & of their Adjournments contrary to the Settled
Times appointed by Act of Assembly

It being offered at the Board that tho the common Law of
England is generally received in this Province yet Several
Statutes of England which may be very beneficial in this
Province are often denyed to be of Authority with us The
sd Statutes not particularly including her Majesty's Plantations
by expresly mentioning them

His Excellency says he believes It may be very advisable
to write to their Agent in England to have the Opinion of
some of the Queen's Council & of others eminent in Law
what Statutes are in force in this Province

Col Ennalls requests the favour of his Excell and this Board
that he may have leave to go home on very urgent Affairs —
which was granted him

The Council adjourned till half an hour after three in the
Afternoon
