This House have considered your message by Col Holland
and three others of the members of your honble Board and
are much surprized to find you put such Interrogatorys to us
as we think we are not obliged to answer We have no

thought of infringing her Majesty's Prerogative and believe
We have not given any one a just occasion to think so and
we are sorry such pretences should be made use of to gratify
any one or delay the finishing this Session We cannot see
any ill consequence will come of our applying our Selves to
the Queen notwithstanding any Clamour & noise the Secre-
tary may make We doubt not but our just Reasons will be
heard, as for that of granting Wine Licences 'tis not as we
take it our Case; but the Granting Licences to Sell Ale Cyder,
Perry &c and Victualling We take to be a part of the power
given to the Justices of the Peace by her Majesty's Commis-
sion and diverse Acts of Parliament
This Affair has already cost the Country a great deal of
Mony and us a great deal of Time but we cannot think any
man will blame us for it but those who are the unjust Cause
of it
We take this proceeding to be nothing else but a design
of wearing us out of a Resolution we have so often assured
you we could not recede from, & to Encrease an heavy Charge
on the Country, which may seem to reflect on us Tho' we
hope we shall easily Satisfy those we represent what the true
Causes of it have been
We pray your Honours to desist from any more Messages
on this Subject we being already resolved to stand & fall by
what our gracious Queen shall determine when our Case is
made known to her

The Honble President having received a Letter from the
Lord Proprietary's Agent Mr Chars Carrol with another Letter
from Capt Richard Smith of St Leonard's Creek to the said
Mr Carrol relating to a tract of Land called Kingsale desired
to be confirmed by this Assembly to Capt Thos Emms &c laid
the same before the Board.
Advised the said Letters be referred to the Consideratior
