234 Assembly Proceedings, Oct. 27-Nov. 14, 1713.

The said Gentlemen brought up a Bill impowering the
Justices of the County Courts to regulate the disputable
Bounds of Several Parishes and ascertaining how and when
the 40 lb of Tobo p poll shall be paid Which was read the
first & second Times by this Board & sent to the Delegates
by Col Tilghman.

Mr Jowles and Mr Pierce brought up three Engrossed Bills
assented to by their House Viz
A Bill against false packing of Tobo
A Bill ascertaining what shall be allowed to Grand & Petite
Jurors in the Provincial & County Courts of his Province and
Evidences Summoned to attend the sd Courts
A Bill for the Relief of Anthony Joye & Ann his Wife
which said Ann is the Daughter & Heiress at Law to Robert

Smith Esqr late of Queen Ann's County decd and the said
Anthony one of the Execrs of the sd Robert Smith's Testament
in Confirming the mortgage of Lands therein mentioned
Which were assented to by this Board and sent to the Dele-
gates by Mr Lloyd
Resolved the following message be sent to the Delegates

By the honble President & Council in Assembly
November the 9th 1713

On Saturday last the honble President received a Letter
from the Right Honourable the Lords of Trade and Plan-
tations of the I4th July last wherein is the following Clause
Viz.

The Acts which we have received shall be considered at the
first opportunity and our opinion thereupon transmitted to you
In the mean time we must observe upon the Act for regulating
Writts of Error & granting Appeals from & to the Courts of
common Law within this Province that by her Majesty's
Instructions you are required to Endeavour to gett a Law
passed wherein the method & Limitation of Appeals from
the inferiour Courts to the Governeur & Council may be
Settled and restrained But you are not to Enact any thing that
her Majesty has already Settled by her Instructions & therefore
all that Clause in the afd which relates to Appeals from the
Governeur & Council to her Majesty ought to be left out the
same being Sufficiently provided for as afd We advise you
therefore to endeavour to gett a new Law passed without the
sd Clause else we shall be obliged to lay the same before her

Majesty for her disallowance. We therefore recommend to
you to reenact that Law this Session according to their Lord-
