referred from the last to this should be discontinued It would
be very inconvenient for then every thing not finished must
begin anew And then to what purpose is any reference when
It is in the power of every Governeur to dissolve the Assem-
bly and have a new one every Session. Or to what Intent
does the House of Commons at the Election of every new
Speaker read some of the Bills that did not pass the Royal
Assent the last Session as it were to give him Seizing of the
House If according to your way of reasoning they were dis-
continued and must begin anew. Neither can we conceive
that your agreeing to this Bill now and passing it into a Law
will be any ways irregular. And since the Lord Proprietary
has been heard by his Agent & Col Smithson by his Council
learned in the Law and we fully satisfyed of the Petitioners
Claim we pray your Honour to agree to this Bill that it may
be Enacted this Session

The aforegoing message being read and debated Resolved
the following answer be sent thereto

By the Council in Assembly
Novemr 12th 1712

Upon reading your Message by Mr Hill and five other
members with the Bill for vesting Sewards Heirs in a certain
Tract of Land in Dorchester County called Sector We must
assert our Opinion thereon that your Endorsment is not Par-
liamentary but mistaken. And what is hinted by you of read-
ing a Bill not passed the last Parliament or a new Bill on In-
stalling the Speaker is no rule for sending up a Bill to the
Upper House with Sundry Endorsments made by the last
Parliament, but it must begin anew (vide Lord Cooks Jur
Courts Title Parliamt folio 27 & 28.) And now as to the
Substance of the Bill We have fully debated it at this Board
and will not take upon us to pass any Act to dispose of the
Lord Proprietarys Lands or direct his Grants thereof And
therefore refer Sewards Heirs to take their Course at Law to
oblige the Lord Proprietary to do them Justice in case It has
been refused them
