The Scheme of officers Fees proposed to be retrenched being
read at this Board his Excy is pleased to ask the Council
whether it be reasonable to retrench any of the sd Fees who
say the Fees are not greater than the service requires Save
the Secretary's Fees for an Injunction an audita Querela and
Writt of Enquiry of Damages which this Board are willing
should be regulated as proposed

Sepr 29th. 1704.
Resolved by this Board that an Address be sent to her
Majesty to Congratulate the Success of her arms under the
Conduct of his Grace the Duke of Marlborough and that the
Thanks of his Excy the Governour and this Board and the
honble Assembly be given her Majesty for placing his Grace
in that Station since the loss of his Majesty King William of

The following messages sent to the House by Col Ham-
mond and Mr Sanders
By the Council in Assembly Sepr 29th. 1704.
We have moved his Excy that whereas in the year 1702 the
then Assembly did vote £ 300 sterl for the assistance of New
York which summe was directed to be paid out of the publick
Treasure of this Province to the order of that Government
when sent for but for as much as the Government of New
York has not yet thought fitt to send for that Sum of Mony
we are induced to suspect they have greater designes against
us and therefore desired his Excy would admitt the same sum
to be remitted to Mr John Hyde in England ready for that
Service in Case the Lord Cornebury shall require the same
otherwise that our Agent might make use of all or any part
thereof to obviate any Machinations by the said Government
of New York against our Constitution if any such be prose-
cuted to which his Excy has been pleased to Assent There-
fore we desire to have your Concurrence therewith signed p
