80 Assembly Proceedings, Sept. 5-Oct. 3, 1704.

Journal.

Col Smallwood brings from the House the following En-
grossed Bills Viz.
A Bill ascertaining the height of Fences &c.
A Bill directing the Sheriffs in their offices and for the more,
easy payment of the publick and County Levys
Which were assented to by this Board and sent to the
House by Col Hammond
The Board adjourns 'till the afternoon

Post Meridiem the Council Sate Present as before

Came Mr Mackall with two Engrossed Bills viz.
A Bill for rectifying the ill Practices of Attorneys &c.
A Bill requiring masters of ships to publish their freight
Which were assented to by her Majesties honble Council and
Sent down to the House by Col Jenkins and Mr Sanders
Mr Robert Skinner brought up a bill for continuing in force
the Act Entituled an Act for ascertaining the Bounds of Land
A Bill confirming the petitionary Act relating to ffree school
which were read the second time and sent to the House by
Col Jenkins & Mr Sanders with the following Messages

By the Council in Assembly Sepr 29th. 1704

Gent. You have considered your Message by Wm Frisby
Major Low and Mr Philips Concerning the address proposed
to her Majesty and your Dependance upon Col Blakiston and
have resolved to joyne with you in the sd Address and doubt
not but his Excy will be inclined thereto likewise Therefore
Propose that it be fairly transcribed

By the Governour & Council in Assembly
Sepr 29th. 1704

We doubt not but many Gentlemen among you are throughly
sensible of what value the honble Mr Blaythwaytes Friendship
may be to this Province in general he being the only Gentle-
man myself or Col Blakiston can apply to on any occasion for
the Ease or advantage of the Province therefore recommend
to your house that you would seriously Consider of the Re-
ference last Assembly to this for settling some annual Salary
on the sd Mr Blaythwayte as he is Auditor General and the
accounts of this Province must all pass through his Hands
