498 Assembly Proceedings, May 15-25, 1705.

3. That after the Magazine Stores are distributed accord-
ing to the former Proposal of the House what remains of the
Powder &ta may be left to his Excellency's Disposal without
the Charge of a Guard.
4. That the Rangers be kept out still as a Guard to the
Frontiers and Respect is to be had to Baltimore County
where the Indians Incursion is to be feared as much as it is on
the Branches of Potowmack until a Peace be actually made
and the Alliances & Stipulations renewed & affirmed,
1. Upon which the House proceed to debate the same.
As to the first Proposal relating to Celey this House leaves
him entirely to his Excellency the Governor to dispose of as
he thinks fit.
2. Second Proposal read & put to the Question whether
Humphry Herman be attainted by Act of Assembly or left to
the Course of the Common Law for Tryal. Carryed by
Majority of Votes that he receive his Tryal by due Course
of Law.
3. This House concurs with the third Article relating to
the Powder
4th Article the House concurs with and resolves That six
Men & an Officer be appointed out of Prince George's County
and six men and an Officer out of Baltimore County Rangers
which being read and debated in the House, Ordered That
it be answered by a Message from the House.
The following Message was read & ordered to be entered
Viz.

By the House of Delegates May 23rd 1705

May it please your Honours,
This House has considered the Message sent to them by
your Honours on Monday last relating to the Satisfying of
Persons employed upon extraordinary Occasions by his Ex'cy
the Governor in her Majesty's & the Country's Service and
that to leave them to the Com. of Accts to make them Satis-
faction for their Services would be too precarious this House
has given Directions to the Com. of Accts to take particular
Care of such deserving Persons and to apportion the Reward

as it may in some Degree answer the Expectation of such
Persons. And this House is very sensible of his Ex'cy's
great Care & tender Regard for the Good & Welfare of the
Province and as they shall not do any Thing detracting from
his Ex'cy's Honour so they will at all Times be ready to make
good such Promises as his Ex'cy shall in the Absence of
Assemblys think fit to make to any pson who serves her
Majesty or this Government upon such extraordinary Occa-
